Let me start by showing you the chart of all the rights for Marvel characters in movies:

So, this really helps one answer the question: Given the current movie rights, who CAN be on the Avengers?
Well, the better question would be... Who cant?

  • Sub-Mariner
  • Man-Thing
  • Spider-Man (And all his villains, minus Iron Patriot). It should be noted Sony is currently in talks With Marvel to merge.
  • Fantastic Four (And all their villains, minus the Kree)
  • Wolverine (And Sabertooth)
  • X-Men (And all their enemies, minus Quicksilver + Scarlet Witch)
  • Cable (And... Well, he's below)
  • Deadpool (He's made too many enemies to know who owns who)
  • Silver Surfer
  • Everyone else, Marvel Studios can use!

Ant Man/Hank Pym (The original inventor of Ultron thank-youverymuch) not being in the films canonically pissed me off.
My favourite iteration(?) of the Avengers has to be The New Avengers, because it's got members from The Illuminati - Black Bolt and Professor X - and Wolverine.

but hey, they're making movies of the Civil War story arc, so the Avengers wouldn't really matter.

Ant Man/Hank Pym (The original inventor of Ultron thank-youverymuch) not being in the films canonically pissed me off.
It has been confirmed that neither Iron Man nor Hydra will create Ultron, but Iron Man will activate him. Being it that Hank is retired, It's possible he still created Ultron in the 60s, despite him not being included in the movie.

I thought tony stark accidentally makes ultron, with the "iron legion" or whatever it is he makes and the ai just becomes like self aware.

I just like the whole Oedipus thing Ultron does with Ant Man and Jocasta etc
